A Quick Guide for Temporary Workers

The Agency Workers Regulations (AWR) were implemented on 1 October 2011. Ace Hire Recruits Ltd has compiled this guide to outline the primary entitlements that our temporary workers may possess under the AWR.

Who is covered by the AWR?

The AWR applies to the temporary workers we provide for assignments to work on behalf of your organization.

What entitlements do temporary workers have?

From the onset of an assignment, a temporary worker supplied by us to a client will have:

● The right to utilize the client’s facilities and amenities, such as the canteen, drinks vending machine, car park, gym, creche, and other similar facilities.

The right to be informed of relevant job vacancies the client may have. Clients may post vacancies on notice boards or on a company intranet and should inform the temporary worker of how and where they can view these vacancies and provide them with access.

● After 12 weeks of working on the same or a similar assignment, a temporary worker supplied by us to a client will have the right to the same basic working and employment conditions as if they had been directly recruited as the client’s permanent employee.

These basic working and employment conditions include:
● Annual leave.
● Rest periods, rest breaks, night work, and the duration of working time.

How will Ace Hire Recruits Ltd ensure temporary workers receive their entitlements?

Ace Hire Recruits Ltd has implemented new procedures that allow us to request clients to furnish details of the basic working and employment conditions falling under 'table 1' during the initial weeks of an assignment. Temporary workers who are registered with other agencies and have previously worked for our client through another agency must inform us of their prior work details. This will enable us to ensure that any relevant previous periods of work are factored into the calculation of the 12-week qualifying period. Through close collaboration with both our clients and temporary workers, we can ensure that the temporary workers we provide receive appropriate levels of pay, holiday entitlements, and other benefits

How is the 12-week qualifying period determined?

The 12-week qualifying period commences when a temporary worker provided by us has worked continuously for a client for 12 calendar weeks on an assignment. Monitoring the 12-week qualifying period can be challenging.
